THIS CONTEST IS OPEN TO LEGAL RESIDENTS OF THE 50 UNITED STATES OR THE DISTRICT OF COLUMBIA. NO PURCHASE NECESSARY. VOID WHERE PROHIBITED.

1. HERE’S HOW IT WORKS: Submit an original color photo of your dog that shows why your dog is an Iams Dog with "healthy vitality" along with a statement of 4,000 characters or fewer describing the appropriateness of your photo to the theme, and then enter into the contest as per the instructions at www.myiamsdog.com. NOTE: Photos and statements must NOT contain or depict anything in a manner that is inappropriate as outlined in Rule #3. Your photo and statement may be posted at myiamsdog.com (subject to the conditions noted in Rule #3). Each month throughout each respective entry period (see chart below), judges will determine the top entry for that month, which will then be posted at myiamsdog.com. At the end of the last entry period, the top 6 entries (one from each entry period), will then be judged by a panel of experts to determine the Grand Prize winner. See the following Terms and Conditions for additional details.

2. ELIGIBILITY: Entry into this promotion is open only to residents of the 50 United States or the District of Columbia who are 18 years of age or older at time of entry and legal owner of the entered dog or have written authority from same. Employees and directors of The Iams Company (“Sponsor”), its parents, affiliates, subsidiaries, advertising, promotion and Internet agencies and their immediate family members and/or those living in the same household of each are not eligible. All federal, state and local laws, taxes and regulations apply. Void where prohibited by law. Eligibility is expressly conditioned on completion of the Publicity Release and the other representations and acknowledgement required at the time of submission.

3. HERE’S HOW TO ENTER:

• Take an original color photo of your dog that shows why your dog is an Iams Dog with “healthy vitality” and then beginning 11:59 PM (ET) on 3/3/08 through 11:59:59 PM ET on 8/31/08, visit www.myiamsdog.com and follow the on-screen instructions to upload your photo and enter your statement of 4,000 characters or less into the contest. Entry periods are as follows:

4. ENTRY REQUIREMENTS:

• All entries must be uploaded and received on www.myiamsdog.com by 11:59:59 PM ET on 8/31/08 to be eligible. Entries received after this time will not be accepted.
• ALL ENTRIES MUST BE YOUR OWN ORIGINAL UNPUBLISHED WORK AND CANNOT CONTAIN, INCORPORATE OR REFERENCE ANYTHING THAT IS OWNED BY ANY THIRD PARTY OR ENTITY OR WOULD REQUIRE THE CONSENT OF ANY THIRD PARTY OR ENTITY IN ANY JURISDICTION, including, but not limited to, commercial or corporate advertising (corporate logos, brand names, trademarks, slogans, and/or political, personal and religious statements) as determined by Sponsor, in its sole discretion.
• ONLY PHOTOS THAT MEET THESE CRITERIA WILL BE INCLUDED IN THE CONTEST.
• Entrant must be legal owner of dog pictured or have proof of owner's authority to enter.
• By entering a photo of your dog, Entrant agrees that photo/statement may be posted online at www.myiamsdog.com. Not all photo/statement submissions will be posted. If Sponsor deems that the photo/statement submission does not comply with the Official Rules of the Contest or if photo depicts usage experiences that do not portray usage of the product in compliance with the Sponsor’s standards and the labeled use of Iams (in Sponsor’s sole discretion),entrant’s photo will not appear on www.myiamsdog.com or be eligible to participate in the Contest.
• You may enter in only one of the six entry periods. Limit of one entry per person throughout the duration of the promotion. Entries will only be judged in the entry period they were submitted in.
• Photos and statements must meet the additional Guidelines below.

Photo/Statement Guidelines:

• Only one dog may be pictured in your photo. No other person or animals including additional dogs may be pictured.
• Entrant must be owner of dog pictured.
• Dog pictured must not be wearing any articles of clothing/accessories except collars, leashes, harnesses or life vests, which are permitted.
• Dog must not be wearing/carrying any unacceptable clothing or adornments, or displaying any commercial/corporate advertising (including but not limited to corporate logos, brand names, trademarks, slogans, and/or political, personal and religious statements) as determined by Sponsor, in its sole discretion.
• Grand Prize winner and dog must be available for photo shoot within a reasonable timeframe as determined by Sponsor, not to exceed December 15, 2008. If winner and/or dog are unavailable, winner will be disqualified and an alternate may be selected if time permits.
• The photo must be in color. Black and white photos or photos that are enhanced with graphics or special effects are not eligible.
• The photo must be in a JPG or GIF format and 500Kb (kilobytes) or smaller, and dimensions must be less than 800 x 600 pixels.
• The statement should not exceed 4,000 characters. If any statement exceeds 4,000 characters, only the first 4,000 will be judged.
• The statement must be in English.
• The photo and statement cannot have been submitted previously in a contest of any kind or exhibited or displayed publicly through any means previously.
• The photo must not contain artwork not created by the entrant.

5. JUDGING TO DETERMINE THE SIX MONTHLY FINALISTS: All eligible entries will be judged by a sponsor-specified panel of experts using the following criteria:

• (Originality & Creativity of photo) – (25%)
• (Healthy Appearance of Dog in photo) – (25%)
• (Appropriateness of photo to Contest theme) – (25%)
• (Appropriateness of statement to theme) – (25%)

In the event of a tie, the tie will be broken based on the highest score for Originality and Creativity.

JUDGING TO DETERMINE THE GRAND PRIZE WINNER: Judging to determine the Grand Prize winner will be accomplished by a panel of experts under the supervision of D.L. Blair Inc., an independent judging agency whose decisions are final on all matters relating to this Contest. Judging will be based on the criteria noted in Rule #4.

6. PRIZES AND APPROXIMATE RETAIL VALUES: (7) Prizes with an approximate retail value of $3,640 will be awarded as follows: (1) Grand Prize – At sponsor’s discretion, your dog will be featured on a limited-edition bag of Iams dog food. A professional photo shoot will be arranged by the Sponsor in or near the winner’s hometown for this purpose; one (1) framed proof from the photo shoot; ten (10) additional unframed proofs from the photo shoot; one (1) framed and matted empty 20-lb. bag of Iams dog food featuring a photo depicting the winning dog; ten (10) empty 20-lb. bags featuring the winning dog and thirty-two (32) 20-lb. bags of Iams dog food featuring the winning dog (four per quarter) for the next two years. (ARV: $640). The Sponsor may also choose to use the winning photo/statement in additional future advertising. There is no monetary value associated with being featured on the Iams bag or use of the photo/statement in future advertising. (6) Finalist Prizes – a year’s supply of Iams dog food (awarded in the form of product coupons). (ARV: $500.00 ea.) Specific food is at Sponsor’s discretion. No assignment, transfer, or substitution of prize is permitted, except by Sponsor in the event of unavailability, in which case Sponsor will award a prize of equal or greater value. ALL FEDERAL, STATE AND LOCAL TAXES, AND ANY OTHER COSTS AND EXPENSES ASSOCIATED WITH THE RECEIPT OR USE OF THE PRIZE ARE THE SOLE RESPONSIBILITY OF THE WINNERS.

7. RIGHT TO USE SUBMISSION AND INFORMATION: Entries and all other submitted material become the property of Sponsor and will not be returned. By submitting an entry: (a) you irrevocably assign to Sponsor all rights, title, copyright and interest in your entry in any and all media whether now known or hereafter devised, in perpetuity, anywhere in the world, with the right to make any and all uses thereof, including, without limitation, for purposes of advertising or trade. The rights granted under this paragraph shall extend to all entries and all other submitted materials related to the promotion, including those submitted by non-winners and winners. ENTRANTS RELINQUISH ALL RIGHTS TO ANY SUBMITTED MATERIAL. By submitting an entry, you grant to Sponsor and its affiliated companies, the right, except where prohibited by law, to use your name, likeness, picture, address (city and state), email address, voice, biographical information and written or oral statements, for advertising and promotional purposes in promoting or publicizing Sponsor and its products or services, without compensation unless required by law. You shall have no right of approval, no claim to compensation, and no claim arising out of any use or use in composite form of your information and/or submission. The rights granted under this paragraph shall extend to Sponsor and its affiliated companies with respect to all entrants in the Contest, including non-winners and winners.

Submissions, as solely determined by Sponsor, must not display unsafe practices or placement of animal; must not contain defamatory words/statements; they must not include threats; they must not disparage or invade privacy or other rights, and they must not in any other way contain material that is unlawful, in violation of or contrary to all applicable federal, state, or local laws and regulations, or the laws and regulations in any state where photograph is taken. Submissions may not contain material that is inappropriate or indecent. The submission must not contain material that violates or infringes another’s rights, including but not limited to privacy, publicity or intellectual property rights, or that constitutes copyright infringement.

8. GENERAL RULES: Potential Finalists (or parent/legal guardian if potential Finalist is deemed a minor in his/her state of residence) will be required to complete an Affidavit of Eligibility certifying that the photo and statement submitted is his/her own original work and he/she holds all rights to the photo/statement and all elements therein, that the photo/statement has not been previously published, has not won a previous prize or award and that he/she has followed the Official Rules of the Contest and that he/she grants permission to post the entry submission online for the duration of the online voting period. Additionally, Potential Finalists (or parent/legal guardian if potential Finalist is deemed a minor in his/her state of residence) may be required to complete a Release of Liability, Prize Acceptance Form and, if legally permissible, a Publicity Release. All documents must be completed and returned within 5 days of attempted delivery of same. Noncompliance within this time period or return of any notification as undeliverable will result in disqualification and an alternate finalist may be selected if time permits. Finalists and Grand Prize winner will be notified by email/mail/phone. By accepting prize, winner (or parent/legal guardian if winner is deemed a minor in his/her state of residence) agrees to release and hold Sponsor, their respective directors, officers, employees and assigns, harmless from and against any and all claims and liability arising out of use of prize or any travel in connection therewith. Winner (or parent/legal guardian if winner is deemed a minor in his/her state of residence) assumes all liability for any injury or damage caused, or claimed to be caused, by participation in this promotion or use or redemption of any prize. By participating in this promotion, entrants (or parent/legal guardian if entrant is deemed a minor in his/her state of residence) agree to be bound by the Official Rules and the judges’ decisions, which are final. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any contest materials and the Terms and Conditions of the Official Rules, the judges’ decisions shall prevail, govern and control. Sponsor/judges reserve the right to reproduce the submissions in full or edit and enhance the submissions at its discretion. Sponsor is authorized to use submissions as it sees fit, including usage in advertising and online without compensation. Sponsor not responsible for any typographical or other error in the printing of the offer, administration of the contest or in the announcement of the Prizes. In no event will more than the stated number of Prizes be awarded.

9. SPONSOR’S DISCRETION: Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds, in its sole discretion, to be tampering with the entry process or the operation of the Contest or website; to be in violation of the Terms of Service of the website; to be acting in violation of the Official Rules; or to be acting in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Any use of robotic, automatic, macro, programmed or like entry or registration methods will void all such entries by such methods, and disqualify any entrants using such methods. In the event of a dispute as to entries submitted by multiple users having the same email account, the authorized subscriber of the email account used to enter the Contest at the actual time of entry will be deemed to be the participant and must comply with these rules. Sponsor reserves the right not to use the Grand Prize picture on any packaging in its discretion, but in such event, Grand Prize winner will receive the balance of the Grand Prize. Authorized account subscriber is deemed to be the natural person who is assigned an email address by an Internet access provider, online service provider or other organization, which is responsible for assigning email, addresses or the domain associated with the submitted email address. Sponsor may prosecute any fraudulent activities to the full extent of the law.

10. LIMITATIONS OF LIABILITY: Sponsor is not responsible for any incorrect or inaccurate information, whether caused by website users, tampering, hacking, or by any of the equipment or programming associated with or utilized in the Contest and assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to the website. Sponsor is not responsible for injury or damage to participants' or to any other person's computer related to or resulting from participating in this Contest or downloading materials from or use of the website. If, for any reason, the Contest is not capable of running as planned by reason of infection by computer virus, worms, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which Sponsor, in the sole opinion of Sponsor, deems could corrupt or affect the administration, security, fairness, integrity or proper conduct of this Contest, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend this Contest and select the winners from entries received prior to the action taken or in such other manner as Sponsor may deem fair and appropriate. IN NO EVENT WILL SPONSOR, ITS PARENTS, AFFILIATES, SUBSIDIARIES AND RELATED COMPANIES, THEIR ADVERTISING OR PROMOTION AGENCIES OR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS, BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF YOUR ACCESS TO AND USE OF THE INTERNET SITE OR THE DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM SAID SITE. Not responsible for faulty, incorrect or mistranscribed phone transmissions, incorrect announcements of any kind, technical hardware or software failures of any kind, including any injury or damage to any person's computer related to or resulting from participating in or experiencing any materials in connection with the promotion, lost or unavailable network connections, or failed, incomplete, garbled or delayed computer transmission that may limit a user's ability to participate in the promotion. Sponsor assumes no responsibility for undeliverable emails resulting from any form of active or passive email filtering by a user's Internet service provider and/or email client or for insufficient space in user's email account to receive email. In the event of termination, a notice will be posted online and entries will be judged from among all eligible entries received prior to termination. Sponsor reserves the right to prohibit the participation of an individual if fraud or tampering is suspected or if the account holder fails to comply with any requirement of participation as stated herein or with any provision in these Official Rules.
